Court Ruling Blocks Construction Of Housing Project

PIERMONT
– A group of concerned Piermont residents has successfully sued the village
board and planning board, blocking construction of what they had described as “an
ugly residential monstrosity” at 447-477 Piermont Avenue.
The
State Supreme Court ruled on October 11 that Piermont’s planning board had
violated the state’s General Municipal Law by unlawfully establishing a Central
Business Multi-Use District in downtown Piermont.
The
business district, which had been established by the passing of Local Law 4 by
village trustees, would have allowed for the construction of a three-story,
14-unit dwelling proposed by Piermont Developers LLC.
On
April 24, Janice Young, Laura Healty-Graznar, John Graznar and Valentina Zitt,
filed their suit against the village, complaining that Local Law 4 had not been
legally adopted.
They
successfully argued that the Village of Piermont had not sought the approval of
the county planning board before adopting the local law, and that the sought
new district required county approval before being implemented.
The
Supreme Court upheld their complaint, finding Local Law 4 invalid, and thus
axing the proposed development.
It
was unknown of the village will appeal the decision.
