Dear Mr. Schnitzer, Attorney Kalla, Mr. Seminara, Mr. Holmes, Ms. Pane, Attorney Bartels, Ms. Youmans, and Colleagues:
 
I am an attorney in New York, and a citizen and resident of the Hamlet of Pearl River, the Town of Orangetown, and the County of Rockland. I write you, for now, not in the course of representing any client, but as a private citizen concerned about my community. My particular concern regards the embattled Village of Piermont, which is also located within the Town of Orangetown and the County of Rockland - and its outgoing lame-duck Mayor Bruce Tucker who has announced that he is not running for re-election.
 
My understanding is that each of your respective companies either insure the Village of Piermont, New York – or else may have insured the Village of Piermont in the recent past. Therefore, you must already be aware that, as a matter of public record, Mr. Tom DiNapoli’s Office of the New York State Comptroller (OSC) is concluding a Risk Assessment of the Village of Piermont, its finances, and its “public officials” initiated last year in 2024. Having discovered bona fide good cause therefor, OSC is now proceeding to a full-blown and in my view well-needed plenary audit of Piermont:

Additionally, there is at least one suggestion in the written record that the pending and ongoing New York State Comptroller Audit of the Village of Piermont is a law enforcement matter:
 
As also indicated in the links above, the Office of the New York State Comptroller recently released many Records to me pursuant to New York’s Freedom of Information Law (FOIL). Insurance documents relating to each of your respective companies were included in that massive FOIL production, which is how I came to conclude that each of your respective companies either insure the Village of Piermont located here in Rockland County and the Town of Orangetown, or else may have insured Piermont in the recent past.
 
Although, as insurance professionals, you are already well-familiar with all the perennial insurance policy buzzwords, each of the following names or phrases came up one or more times in the voluminous Piermont insurance policy documents. I list them alphabetically and indicate the ones of particular interest to you and to me in bold-face type immediately below:

With those specific topics so noted, my questions to each of you regarding the New York State Comptroller Audit of Piermont and the subject insurance policies and coverage, are as follows:
 
1. Audit Damage. If and assuming that the Village of Piermont and/or its taxpaying residents incur or otherwise suffer fines, penalties, or other economic loss as a result of the New York State Comptroller Audit and/or the presumptive issuance of OSC’s written Audit report thereafter, are these people insured and covered for the full extent of that loss by one or more of the subject insurance policies referenced hereinabove?
 
2. Criminal Defense. If and assuming that state or federal law enforcement action of a criminal or administrative nature is taken as against the Village of Piermont, its Mayor Bruce Tucker, its Trustees, its Board Members, or any persons or entities associated therewith, will one or more of the subject insurance policies referenced hereinabove cover and pay for the defense or defenses?
 
3. Criminal Action Damage. If and assuming that state or federal law enforcement action of a criminal or administrative nature is taken as against the Village of Piermont, its Mayor Bruce Tucker, its Trustees, its Board Members, or any persons or entities associated therewith, will one or more of the subject insurance policies referenced hereinabove serve to indemnify and protect the taxpaying residents of Piermont against any ensuing damage thereby caused?
 
4. Molestation Coverage. Finally, as unsavory a topic as it is, I could not help but notice the explicit references to the words “abuse” and “molestation” in the Piermont insurance documents which I obtained as public Records from the Office of the New York State Comptroller pursuant to FOIL:

I am presuming that these references were not gratuitous and do not typically appear in municipal insurance files, but in Piermont’s case are instead the product of the horrible Piermont Fire Department abuse matter occurring approximately a decade-and-a-half ago - in which at least one minor was apparently subjected to the sexual abuse of pedophilic sodomy during a disgusting Piermont Fire Department alias "Empire Hose Co. No. 1" hazing “initiation”:
 
 
Perhaps even more concerning, both of the alleged perpetrators of the claimed pedophilic sexual abuse received payments from the Village of Piermont as of the time periods 2023-2024 and 2024-2025. In other words, the two alleged perpetrators appear to still be located in the community. Please see:

My question to each of you is, as insurers against this kind of horrific eventuality ever again occurring in the future, what if any ameliorative measures have you or your respective companies taken in more recent years to ensure that this type of catastrophic thing never occurs again? For example, has there been any re-training or re-education put in effect with the Piermont Fire Department and Piermont Village government generally to hedge against that gruesome possibility, as a pre-condition to insurance coverage of Piermont or otherwise? I have to believe that it is in the fiscal interest of each of your companies, not to mention in the moral interest of each of your companies as well, to impose such pre-conditions of insurance coverage on the Village of Piermont to ensure that there will never be any repeat of that hellish scenario reported as public record back in 2011 as per the links above.
